A lives next door, R knew ella about a year. A treated Ella well, relevant whether Abrams cared for Ella. Last saw in December. Seemed odd. R going to house to leave note, had lost her (A) phone numbers. Flies on inside of windows, odor of death the closer you got to the house, felt Abrams may be in the house passed away.

Established that neighbor (R) lives on the left side if looking at house from the road.

Defense questions: Asked age, medical training, R in army 79-83, truck driver, alarm investigator in Mobile, AL for Engerby Security mid 80's. (lots of questions about being an alarm investigator and having come across a dead body in a mortuary -- witness establishing he knows what a dead body smells like) smelled a dead body in Frankfurt when 10 (S asked who was with him but objection and it never was asked).
When did R call police? 3/12/08.
Does A drive a vehicle? little grey car and a wagon sometimes.
Did see vehicles in driveway? no.
See lights on? lights always on.
Hear AC running? no
Hear radio or noise? no
Somewhere in here it is mentioned that R could not look in the windows cause the inside shutters were closed.
Called 911 around 6:30
What did R tell 911? same as above and that he had her phone number but not mothers.
Police came about 10 mins later.
Told ofc flies, odor, concern, didnt see A around.
Did not describe vehicle to police.
Did not give A phone numbers to police.
Know of any deliveries, newspaper, UPS, etc? answered no to all
Didn't see mailman go to A's house.

R knocked on door, looked at windows, saw flies, smelled odor, backed away and called 911.

What did first officer do? walked around the house.
Did R speak to the SA? yes
S says he wants to show that R was coached by SA.
Explain. R got a letter to appear in court, the letter said to call. when R called they said he did not have to be there on the 17th the date was changed, they did not know the new date.
When was this? a few weeks ago.
And what else was said? R told the SA what he knew, he said he was the neighbor who found Ella [s makes a big deal over this, that R did not find ella that R is like on some high telling people that he found ella when in fact he did not find ella, the police did, it was crazy].
Was he asked his name? yes.

Particulars of what occurred? (i dont have whether yes or no but i know that R said he did the talking and that he was not told anything about the case)

At this point Judge says to S that she sees S is not used to a podium and is walking around too much, he needs to stay near the microphone on the podium. S says there are plenty of microphones and gestures to the press area! Judge says S needs to stay near the digital recording mike so the court can pick up his questions. This is when S moves the podium. And he moves it right in front of the prosecutors desk, between the witness and the prosecutors desk, blocking the view of the witness stand from the prosecutors desk.

Did you accompany the officer around the house? no.
How far was R from home while officer searched.? standing in yard in front of porch.
How far from the front door? approx 25 feet (this was not cut and dry, cause R said from where he was to the podium and S said that was 25 ft and R said okay).
Could R smell the odor of death? yes.
Where is the mailbox? on the curb.
Did you look in the mailbox for mail? no.
Did R tell any officer whether he saw Ella inside of house in crate? no
What did 1st officer do after searching perimeter of house? doesnt remember.
Did you enter the home? no.
How did officer enter? Through the window and they establish that it is the windo on the side facing R's apartment.
Was the front door locked? yes.
Windows locked? believe so.
Didn't you have a key? no
Did you try front door? no
How know door locked? officer came back and said everything was locked up to the Sgt that showed up and R heard it.
How long til Sgt showed up? short time later (now there is this big thing about time, what is short, is 5 min short, is 10 short is 20 short.... They go up to the bench a few times.

One of the times that they go up to the judge, S first walks over to A at the defense table and says to her "they have no evidence"


Perimeter is done being searched. Did you hear officer call for anyone? No, talking to a friend (oh boy now we have to know all about the friend, how he knows him, does he always come by, how long was he there (5-6 mins), R sent friend on his way R said he was busy, did cops talk to friend, how do we spell friends name...David Guthrie - poor guy!)

When first officer entered house was it without the sgt? no.
Sgt arrives, who next? Another officer
Didn't Animal Control arrive? yes, they were there.
now we have a big to do over who came when and when someone came was David Guthrie there. this was all to get a timeline.

Isn't time critical to a mission? Responding to security is based on time? these kind of questions.
Brought up ended security job in 80's. other jobs was manager of restaurants, isnt time important? be sure patrons are seated in a timely manner, the waitress getting food to customer, the personnel, getting food from kitchen all time related. very boring.
Who entered the house through the window? The first responding officer.
Can you describe him? Can't see him but I would know him if I saw him. Determined that he is white, over 30 prob not over 40, dk hair.
Color of his eyes? i dont know.
Color of the uniform? dark blue.
Asks color and shape of badge, gold or silver, star shaped or shield shaped. (all very critical i am sure)
Color of vehicle? Cocoa City PD car
Did he hand you a business card? no
In the end you filled out a statement on Mar 12? yes. R wrote it out in his own hand and signed it. Then R was given a case number.
S asks to see the written statement and R turns it over to him.
S looks at it brings it over to Abrams and i think he asks her to copy it down.
Determines statement was written on hour later after he had gone to the house to leave a note (i dont think i mentioned that but at some point R said he was going over to leave a note.. maybe that is later in the notes...)
Was R asked to write the statement? yes, sgt asked R to write a statement.
Did R ask what he should write? no
Were all officers wearing the same uniform? Sgt was wearing a white shirt.
How many officers responded? 4 maybe 5 they were coming and going. dont believe all were there at the same time. Animal Control was there til the end.

You said you look after the house (on the statement)? yes, we're neighbors we keep an eye on each other.

here is a good part. stine has given back the statement i think at this point and says to R what day is December 7th. R asks do you mean what day of the week? S moves over to where A was writing the copy of his statement (i only think that is what she was doing) and in the meantime we are all looking at each other and saying Pearl Harbor day?? I am not sure if Raska objects, we were all kind of confused by this question. S comes back and says something like what happened in history? R doesnt know. S says it is pearl harbor day is it not and R says he doesnt know. S says you were in the military, you had military upbringing (established when he was in germany as a kid) and you dont know that Dec 7th is Pearl Harbor day?
R doesnt flinch and simply says no i didn't.
S asks R then how can you remember that you last saw A on December 7th (i immediately knew where this was going and i was already chuckling at this guys incredible incompetence... REMEMBER his motion to suppress asks that the evidence that was found at the Abrams house on January 18th be suppressed. January 18th.... cops were there March 12. and in his motion he has that date TWICE. but what is significant about that date? that is the date that abrams said was the last time A checked on Ella. the 18th or 19th, i am too lazy to go check)
R says he never said that the last time he saw A was Dec 7th. He said December.
S goes over gets the statement and has R read it out loud. i think by now the whole courtroom knew what was going to happen.
R reads his statement and says he last saw A in December of 07.

Just a note, S never calls the dog Ella, but the prosecutor does. I know that is a common tactic, but i wanted to point it out, anyway

Stine points out that A did not live at that address in 2006 and that she moved in in June of 2007.

I have ID abrams in the notes but i dont know what that pertains to.

Of course it likely did not take you the two hours to read this. that is how long it took to get the testimony, tho! so it shows how much other bull was going on.
